The court has fixed Tuesday (February 22) for hearing on the rule issued on the writ petition filed by Zayed Khan for the post of general secretary of Bangladesh Film Artists Association.
A bench of the High Court comprising Justice Mamnoon Rahman and Justice Khandaker Diliruzzaman set the date on Tuesday (February 15) in response to a plea by Nipun's lawyer. Barrister Rokon Uddin Mahmud and Barrister Mostafizur Rahman Khan were in favor of Nipun in the court. Zayed Khan was represented by senior lawyers Yusuf Hossain Humayun, Ahsanul Karim and Nahid Sultana Yuthi.
Nipun's lawyer Barrister Rokon Uddin Mahmud later said that an affidavit had been submitted by Nayak Zayed Khan to attach some documents in the writ. We received them at 10:30 this morning. The court was asked for time to study these documents. The court then fixed the next day for hearing the rule next Tuesday.
Earlier on Monday (February 14), the Appellate Division upheld the stay order of the Chamber Court on the High Court order regarding the post of General Secretary in the election of Bangladesh Film Artists Association. At the same time, the Supreme Court asked to hear the rule in the High Court.
Actress Nipun Akhter has filed a petition seeking cancellation of Zayed Khan's candidature alleging 'vote buying' during the election. He even demanded re-election to the post. The Appellate Board of the Artists' Association will sit in the FDC on Saturday (February 4) afternoon as per the pre-announcement on whether the post or candidature of Zayed Khan will be canceled in the light of that application. According to the decision of the Board of Appeal, Zayed Khan's candidature was rejected and Nipun was declared general secretary.
In this context, on Monday (February 7), the film actor Zayed Khan filed an application in the High Court challenging the validity of the cancellation of the candidature of the Appellate Board. Earlier, in the wake of the writ petition filed by Zayed Khan, the same virtual bench of the High Court on February 7 issued a rule in this regard.
Later, Nipun applied for stay of the order given by the High Court. On February 9, the Appellate Division Chamber Judge's Court stayed the High Court's order and remanded Nipun's application to the regular bench of the Appellate Division for hearing on February 13. At the same time, he instructed the two parties (Nipun and Zayed) to maintain the status quo while performing the duties of the general secretary of the industrial association. But Nipun's lawyer said he would leave to appeal on the scheduled date (February 13). In this context, the matter was for hearing.
The next day, on Monday (February 14), the Appellate Division upheld the chamber court's order suspending the High Court's order for the post of general secretary of the Film Artists' Association. At the same time, the status of general secretary has been maintained. Besides, the court directed the High Court to settle the issue. A rule hearing is scheduled to be held today in its continuation.
According to the preliminary results of the 2022-24 election of the Film Artists Association held on January 28, Zayed Khan was declared the winner for the post of General Secretary. Opposition candidate Chitranaika Nipun later accused Zaid of influencing the election, including "buying votes with money". Seven days after the vote, on February 5, the Chairman of the Appellate Board, Sohanur Rahman, declared Sohan Nipun the uncontested general secretary. Since then, Zayed Khan has been claiming that the matter is 'illegal'.
Meanwhile, a new committee headed by Elias Kanchan and Nipun Akhter was sworn in at BFDC premises on the afternoon of February 8. Later they went to the office of the artist association and sat in their respective chairs. The members of the association greeted them with flowers.
The next day, on February 8, Zayed Khan filed a writ petition in the High Court challenging the decision of the Appellate Board declaring Nipun Akhtar as the General Secretary. The High Court stayed the decision of the Appellate Board on the same day.
On February 8, Nipun's lawyer appealed to the concerned branch of the Appellate Division seeking stay of the High Court order. Following the hearing of the appeal on February 9, Chamber Judge Obaidul Hasan stayed the High Court's order suspending the decision of the Appellate Board for the election of the Film Artists' Association.
At the same time, the chamber judge suspended the post of general secretary of Bangladesh Film Artists Association till February 13. It was also informed that Zayed-Nipun will not be able to sit in the chair of the general secretary during this period.
According to the lawyers, the order of the High Court regarding the post of General Secretary of Bangladesh Film Artists Association is also pending in the Appellate Division of the Supreme Court. At the same time, the order issued by the Chamber Judge of the Appellate Division to maintain the status quo of the two parties (Nipun Akter and Zayed Khan) in the post of General Secretary of the Industries Association will continue.
The court said the two parties (Zayed and Nipun) have submitted that the matter (rule hearing) in the High Court is scheduled for hearing on Tuesday (February 15). In this case, the application (disposed of) was disposed of. The chamber judge's order will continue.
