Nazrul Islam Shamim, state counsel for the tribunal, said the court had framed charges against Asif under Section 57 (2) of the Information and Communication Technology Act. 

The court fixed June 23 for taking evidence in the case.On Monday (November 8), Asif appeared before the Dhaka Cyber ​​Tribunal in a case filed by musician and composer Shafiq Tuhin. The case was scheduled to be heard on the same day. The prosecution held a hearing on the charges against him.


Asif's lawyer, on the other hand, pleaded not guilty to the charge. Dhaka Cyber ​​Tribunal Judge Assam Jaglul Hossain fixed January 13 for further hearing after hearing both sides.On the evening of June 4, 20168, musician and composer Shafiq Tuhin filed a case against Asif under the Information and Communication Technology Act at Tejgaon Police Station. Apart from Asif, there are four or five other unnamed accused in the case.


In the statement of case, the plaintiff Shafiq Tuhin mentioned that through the investigative report of Channel 24's searchlight program on June 1, 2018 at around 9 pm, he came to know that Asif Akbar had sold 617 songs of other lyricists, composers and artists without his permission. 

Later he came to know through various means that Asif Akbar as Chairman of Arb Entertainment through Digital conversion of songs through On-Mobile Private Limited Content Provider, Nexnet Limited, Gak Media Bangladesh Limited and other organizations, True-Tune, WAP-2, Ringtone, PRTB, Commercially used as wallpaper, animation, 3G content, etc., have made huge profits through dishonesty and fraud.


In the wake of the incident, Shafiq Tuhin posted a post on his personal Facebook account at 2:22 pm on June 2 of that year. Below that post, Asif Akbar made indecent remarks and made threats from one of his own accounts. At 9:59 the next night, Asif Akbar came live on his verified Facebook page with about 32 lakh likes. From the 22nd minute of the 54 minutes 34 seconds live video, he made derogatory, obscene and false statements against Tuhin.


In the video, Asif Akbar told the fans to "punish him (Shafiq Tuhin)" and told the fans, "Resist him wherever you find him." Millions of people have seen this statement of Asif Akbar. He provoked. This has brought him (Shafiq Tuhin) into disrepute.Shafiq Tuhin mentioned in the statement that many people including well-known artist, composer and lyricist Pritam Ahmed know about the matter.


On November 20, 2019, the investigating officer of the case filed two separate chargesheets against Asif under the Information Technology and Penal Code.
